SceneBlast (“SceneBlast”, “we”, or “our”) proudly offers audience management, event promotion, social media, and communication tools (the “Services”) for bands, musicians, promoters, venues, event organizers, and other organizations or individuals (“Organizations”), as well as their team members, fans, contacts, and audiences (collectively, “Users” or “you”).

In order to use our Services, you will need to review, agree to, and adhere to the following terms and conditions for use, including the Community Standards and Acceptable Use Policy (the “Terms”). We also encourage you to review the SceneBlast Privacy Policy, which is incorporated by reference within these Terms.


Your Data

SceneBlast abides by all applicable privacy and data protection laws. Our Privacy Policy provides additional details about how we treat and protect your personal information.

When you provide SceneBlast with information relating to fans, customers, contacts, team members, or other individuals, you represent that you have the appropriate rights, authorization, or consent to provide that information to SceneBlast and use it through the Services.

You are responsible for ensuring that your use of contact information, marketing communications, social media accounts, and other data through SceneBlast complies with applicable laws, regulations, platform requirements, and consent obligations.


Indemnification

You agree to indemnify and hold harmless SceneBlast, its contractors, licensors, partners, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of our Services, including but not limited to any violation of the Privacy Policy, these Terms, applicable law, third-party platform requirements, or the rights of another person or organization.


Disclaimer of Warranties

Our Services are provided on an “as-is” basis, and we make no guarantees that the Services or platform will be free of errors, interruptions in service, delays, third-party platform failures, or technical issues.

We make no warranties, express or implied, and hereby disclaim all implied warranties, including any warranty of merchantability and warranty of fitness for a particular purpose.

SceneBlast relies on third-party platforms and services in order to provide certain functionality. We do not guarantee the continued availability, functionality, policies, permissions, APIs, or services of any third party, including social media platforms, email providers, messaging services, payment processors, or hosting providers.


Limitation of Liability

By using our Services, you agree that the remedies for your dissatisfaction with the Services include discontinuing use of the Services, deleting your account, or contacting SceneBlast at holler@sceneblast.com.

Where allowed under applicable law, in no event will SceneBlast, its directors, officers, employees, third-party affiliates, partners, contractors, or agents be liable for:

  • Any special, incidental, indirect, or consequential damages related to your use of our Services;

  • Any interruption of the Services or loss, corruption, deletion, delay, or unauthorized access to data;

  • Failure, suspension, restriction, or modification of a third-party service or social media platform;

  • Failure of scheduled, automated, or assisted content to be published, delivered, displayed, or received;

  • Actions taken by social media platforms or other third parties against your accounts or content; or

  • Any related lost profits, revenue, business opportunities, goodwill, or audience engagement.

Our liability arising from the Privacy Policy, these Terms, or the use of our Services will not exceed the greater of $100 or the total amount you have paid us for the Services during the preceding 12 months.


Termination of Services

We may, in our sole discretion, restrict your access to all or part of the Services, deny providing Services, remove content, revoke access to an Organization or team, disconnect integrations, or permanently delete your account at any time, with or without reason and with or without providing notice, to the extent permitted by applicable law.

Termination of your SceneBlast account does not necessarily terminate accounts, services, subscriptions, or relationships you maintain directly with third-party platforms.


Third-Party Platforms and Social Media Accounts

SceneBlast may allow Users to connect accounts or services provided by third parties, including social media platforms.

By connecting a third-party account, you authorize SceneBlast to access, use, transmit, receive, schedule, format, publish, or otherwise interact with information or content associated with that account to the extent necessary to provide the functionality you request.

Your use of third-party platforms remains subject to the applicable platform’s own terms, policies, permissions, and restrictions.

You are responsible for maintaining authorization to use any account you connect to SceneBlast. You may not connect, control, publish to, or otherwise use an account through SceneBlast unless you are authorized to do so.

SceneBlast is not responsible for restrictions, suspensions, account actions, content removals, changes to APIs, permission changes, service interruptions, or other actions taken by third-party platforms.


User Content and Promotional Content

Users may provide SceneBlast with event information, images, flyers, text, links, social media content, marketing materials, contact information, and other content (“User Content”).

You retain ownership of your User Content.

By submitting User Content to SceneBlast, you grant SceneBlast a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, format, transmit, display, publish, and otherwise process that content solely as reasonably necessary to provide, operate, and improve the Services.

You represent that you have the rights and permissions necessary to submit and use User Content through SceneBlast.

SceneBlast does not claim ownership of User Content and is not responsible for disputes between Users or third parties regarding ownership, authorization, accuracy, or use of User Content.


Marketing Communications and Consent

SceneBlast provides tools that may allow Users to collect contact information, manage audiences, and send or facilitate communications to fans and other contacts.

Users are responsible for ensuring that they have all consent, permission, or other lawful basis required to contact individuals using information stored or managed through SceneBlast.

You may not use SceneBlast to send communications to individuals when you do not have the appropriate permission or legal authority to do so.

Users are responsible for complying with applicable marketing, email, text messaging, privacy, anti-spam, and consumer protection laws, as well as honoring unsubscribe requests, opt-out requests, communication preferences, and withdrawals of consent.

SceneBlast may provide tools to assist with consent collection and preference management, but you remain responsible for determining whether your communications are lawful and appropriate.


Intellectual Property Violations

If you believe a User has violated the intellectual property rights of another person or organization, you may report the content by contacting Todd Little or Kattie Jackson at holler@sceneblast.com.

If we determine that there has been an infringement or that removal is otherwise appropriate, the applicable material may be removed from the platform.

Please include the following information:

  • A list or description of each individual registered or protected work claimed to have been infringed (the “Work(s)”);

  • A description of the location of each Work or allegedly infringing material on the platform, including the URL where applicable;

  • Contact information of the complaining party, including name, address, telephone number, and email address;

  • A statement that the complaining party has a good faith belief that the disputed use is not authorized by the owner of the Work, its agent, or the law;

  • A statement that the information provided is accurate; and

  • A statement, made under penalty of perjury, that the complaining party is the owner of the Work(s) or authorized to act on behalf of the owner.


Future Amendments

We reserve the right to make changes or updates to these Terms at any time, so we encourage you to periodically return to review them.

Your continued use of the Services following any updates shall mean that you agree to and accept such changes, to the extent permitted by applicable law.


Governing Law and Venue

Our Services are protected by applicable copyright, trademark, and other United States and foreign laws.

All claims arising out of or relating to the Privacy Policy, these Terms, or the use of the Services will be governed by Georgia law.


Dispute Resolution

A good-faith attempt to resolve any issue with SceneBlast must be made before the escalation of any claim or dispute.

Please include a description of your issue, any other pertinent information, and the resolution you seek in your email to Todd Little or Kattie Jackson at holler@sceneblast.com.

If a dispute cannot be resolved mutually, the parties agree to pursue mediation before litigation or arbitration as otherwise provided below.

YOU AGREE THAT ALL CLAIMS, WITH THE EXCEPTION OF CLAIMS RELATED TO INTELLECTUAL PROPERTY, WILL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION. IF YOUR CLAIM QUALIFIES FOR SMALL CLAIMS COURT, YOU MAY ALSO BRING YOUR CLAIM THERE. FOR ANY CLAIM THAT IS NOT ARBITRATED OR RESOLVED IN SMALL CLAIMS COURT, YOU AGREE THAT IT WILL BE RESOLVED EXCLUSIVELY IN THE APPLICABLE STATE OR FEDERAL COURTS LOCATED IN GEORGIA. YOU AND SCENEBLAST EXPRESSLY WAIVE A TRIAL BY JURY.


Community Standards and Acceptable Use Policy

At SceneBlast, we’re committed to providing a safe, respectful, and reliable platform where bands, promoters, venues, fans, and other members of the music and events community can connect, communicate, and promote events.

By using our platform, you agree to the following expectations (the “Expectations”):

  • Minimum Age Requirement: Users must be 18 years or older to create or operate a SceneBlast account. We do not knowingly collect or permit account activity from anyone under the age of 18.

  • No Harassment or Abuse: Users may not harass, threaten, defame, intimidate, stalk, or abuse others through the platform.

  • No Illegal Activity: You agree not to use SceneBlast for any unlawful purpose, including fraud, identity theft, impersonation, distributing malware or viruses, facilitating illegal activity, or violating the rights of another person.

  • Respect for Intellectual Property: Do not upload, publish, schedule, distribute, or share content that infringes another person’s copyright, trademark, publicity rights, or other protected rights.

  • Authorized Account Access: You may only connect or manage social media accounts, Organizations, teams, pages, profiles, or other resources that you are authorized to access.

  • No Unauthorized Marketing or Spam: You may not use SceneBlast to send unsolicited or unlawful marketing communications, purchase or improperly obtain contact lists, circumvent opt-outs, or communicate with individuals without appropriate permission.

  • Honor Consent and Communication Preferences: Users must respect marketing consent, unsubscribe requests, opt-outs, communication preferences, and other restrictions communicated by fans or contacts.

  • No Platform Misuse: Do not use unauthorized automated bots, scraping tools, spam tools, exploits, or any other method that interferes with the security, availability, operation, or experience of SceneBlast or its Users.

  • Truthful Representation: You must provide accurate information when creating an account, representing an Organization, joining a team, connecting a social account, creating an event, or communicating with others through the platform.

  • Content Responsibility: You are responsible for content you upload, schedule, publish, distribute, or authorize SceneBlast to publish on your behalf.

  • Third-Party Platform Compliance: You agree to comply with the applicable terms, policies, community standards, and requirements of any third-party platform you access or use through SceneBlast.

  • Reporting Misuse: You agree to report inappropriate content, unauthorized account use, abuse, or breaches of these Expectations to SceneBlast at holler@sceneblast.com.

  • Right to Remove Content or Accounts: SceneBlast reserves the right to remove or restrict content, communications, integrations, Organizations, or accounts that violate these Expectations.

  • Right to Update Terms: SceneBlast reserves the right to amend, modify, and update the Community Standards and Acceptable Use Policy. Continued use of the Services indicates your acceptance of any amendments.
